What is the Charter Act of 1686?


In the Charter Act of 1686, King James II confirmed the privileges granted by the previous charter with slight modifications. This charter increased the jurisdiction of the Court of Admiralty in maritime cases and gave power to the presidents, agents, chiefs, and council to administer oaths.

Significance of the Charter Act of 1686


  • Under this, the Governor and the Council and their respective president, agents, and chiefs were empowered to administer oaths to the employees of the Company.

  • The Governor, Deputy Governor, and court of the company were given the power, license, and authority to appoint Governor and officers to forts, factories, and plantations.

  • These governors and officers of forts, factories, and plantations were in turn given the power to raise, arm, and train forces necessary and required to exercise Martial law.

  • To Tackle the loss and damages caused by trade by native princes, interlopers, and other factors, the charter gave power to the governor and the company to appoint  
    • Admirals
    • Vice Admiral
    • Rear admirals
    • Captain and 
    • Other sea officers 
in the ship serving the company.

  • These officers were in turn given the power to raise, arm, and train such a number of seamen or other military soldiers in their respective ships

  • The officers appointed for this purpose will be ordered and directed by the Governor and the company or Captain General of the English in India appointed by the Governor and the company.

  • The Charter granted the company to fort mint any species of coins of local rulers in their fort but not European coins.

  • The king officers should aid and assist the company or persons employed by it on a request basis.

  • All provisions in the charter of 1686 are to be constructed in a manner favorable to the company unless the contrary is proved.

  • The main significance of this charter is the separation of judicial function from the Governor and the Council.
